A. GENERAL TERMS AND CONDITIONS

1. Scope of Application

(1) These General Terms and Conditions of HS Heritage GmbH (hereinafter "Seller") apply to all contracts concluded between a business customer or consumer (hereinafter "Customer") and the Seller regarding the goods and/or services presented in the Seller’s online shop.

(2) Any terms and conditions of the Customer that deviate from or conflict with these Terms and Conditions shall not apply, unless expressly agreed otherwise in writing.


2. Conclusion of Contract

(1) The product descriptions in the Seller’s online shop are non-binding and serve solely as an invitation to submit a binding offer by the Customer.

(2) The Customer submits a legally binding offer by completing the order process via the online order form and clicking the button to finalize the order.

(3) The Seller may accept the Customer’s offer within five (5) days by:

  • sending a written order confirmation or confirmation by e-mail, or

  • delivering the ordered goods, or

  • requesting payment after the order has been placed.

The contract is concluded as soon as one of these alternatives occurs first. If the Seller does not accept the offer within the five-day period, the offer shall be deemed rejected.

(4) Order processing and communication generally take place by e-mail. The Customer must ensure that the e-mail address provided is correct and can receive communications.


3. Prices and Payment Terms

(1) All prices are displayed in Euro.

  • Within the European Union (EU): Prices include the value-added tax (VAT) applicable in the country of delivery (OSS scheme).

  • Outside the EU (e.g., Switzerland, UK, USA): Prices are displayed without VAT. The Customer is responsible for any import duties, taxes, or customs fees in the destination country.

(2) Packaging, shipping, insurance (especially transport insurance), customs duties, and other charges are calculated separately and shown during checkout.

(3) The Customer may choose among the payment methods offered in the online shop (e.g., Shopify Payments, PayPal, bank transfer in advance).

(4) For prepayment, payment is due immediately upon conclusion of the contract. Bank details:

Any bank or transfer fees are borne by the Customer. The order will be shipped once payment has been credited. Refunds are made to the same account used for the original payment.

4. Delivery and Shipping Conditions

(1) Deliveries are made to the shipping address provided by the Customer.

(2) Shipping costs are borne by the Customer. They are displayed separately during the checkout process and depend on order weight, volume, and destination country.

(3) Delivery times within Germany are usually 3–5 working days, and no later than 15 days in peak seasons (e.g., Christmas). Delivery times abroad may vary.

(4) Free shipping may occasionally be offered within Germany or the EU through discount codes. Outside the EU, shipping is always chargeable.

(5) The risk of accidental loss or deterioration of goods passes to the Customer upon handover to the carrier, even if the Seller bears the shipping costs. Transport insurance is only provided upon express request and at the Customer’s expense.

(6) If delivery is not possible for reasons attributable to the Customer (e.g., insufficient access, absence despite notification), the Customer bears the costs of the failed delivery attempt.

(7) In the case of self-collection, the Seller will inform the Customer by e-mail once the goods are ready for pickup. No shipping costs are charged for self-collection.


5. Returns and Return Shipping

(1) Returns must comply with statutory provisions.

(2) Goods must be returned exclusively in their original packaging and undamaged. Returns in damaged or unsuitable packaging may be rejected.

(3) The Customer bears the costs of return shipping. The Seller does not accept unpaid (collect) returns.

(4) Refunds are issued only after inspection of the returned goods. Any reduction in value due to improper handling or packaging may be deducted from the refund.


6. Retention of Title

Ownership of delivered goods remains with the Seller until full payment of the purchase price and all outstanding claims has been received.


7. Liability

(1) The Seller shall be liable without limitation in cases of intent or gross negligence, in the event of injury to life, body, or health, and under mandatory statutory provisions such as the Product Liability Act.

(2) In cases of slight negligence, liability shall be limited to foreseeable and typical damages.

(3) Any further liability is excluded.


8. Governing Law and Jurisdiction

(1) All legal relations between the parties shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes shall be the Seller’s registered office in Lübeck, Germany.

(3) The contract language is German.


B. CUSTOMER INFORMATION FOR ELECTRONIC COMMERCE

  1. The technical steps for contract conclusion correspond to the order process described in Section 2.

  2. The contract text is stored by the Seller and can be accessed by the Customer via their password-protected account, if created.

  3. Input errors can be corrected at any time during the order process and are displayed in a confirmation window before submission.

  4. The only language available for contract conclusion is German.

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
